EU Digital Regulatory Assessments

Know what applies. Understand what to do. Manage the risk.

The EU’s digital regulatory landscape is becoming increasingly complex. The AI Act, NIS2, Data Act, Cyber Resilience Act and Digital Services Act create new—and sometimes overlapping—obligations for businesses operating in Europe.

For companies, this raises three fundamental questions:

Does the law apply to us?
If it does, what do we need to do?
What legal risks do we need to manage?

Proust Legal’s EU Digital Regulatory Assessments provide clear, practical answers.

◎ SCOPE → ✓ COMPLIANCE → ◈ RISK

Does it apply? → What must we do? → How do we mitigate the risk?

◎ 01 — SCOPE

Legal Scope Assessment

Does this EU law apply to your business?

Before investing in compliance, you need to know whether the legislation actually applies to your organisation, products or services.

Through a focused legal questionnaire, Proust Legal assesses whether your business falls within the scope of the:

EU AI Act · NIS2 Directive · EU Data Act · Cyber Resilience Act (CRA) · Digital Services Act (DSA)

Depending on the legislation, the assessment considers the relevant territorial and material scope requirements, your activities, products or services and your potential role or regulatory status.

What you receive

📄 A written Legal Scope Assessment setting out:

  • whether the selected legislation applies to your organisation, product or service;
  • the legal basis for that conclusion;
  • your relevant regulatory role or status, where applicable;
  • any material areas of uncertainty or issues requiring further analysis; and
  • recommended next steps.

The result: a clear answer on your regulatory perimeter before you invest in compliance.

✓ 02 — COMPLIANCE

Compliance Assessment

You’re in scope. Are you ready to comply?

Once a law applies, the next step is understanding which obligations apply to your organisation—and whether you are meeting them.

Using a structured questionnaire and targeted review of your existing measures, Proust Legal assesses the applicable legal requirements against the policies, processes, controls and governance arrangements you already have in place.

What you receive

📋 A written Compliance Assessment & Action Plan including:

  • a summary of the key legal obligations applicable to your organisation;
  • an assessment of your existing compliance measures;
  • identification of compliance gaps and areas requiring improvement;
  • prioritisation of the principal issues identified; and
  • practical recommendations and actions to address those gaps.

The assessment gives legal, compliance and business teams a practical roadmap for implementation rather than simply a list of regulatory requirements.

The result: a clear picture of where you stand, what is missing and what you need to do next.

◈ 03 — RISK

AI Legal Risk Assessment

Developing, procuring or deploying an AI-powered product or service?

The AI Legal Risk Assessment is a bespoke legal analysis of a specific AI system, model, AI-powered product, service or use case.

Proust Legal assesses your organization’s use, acquisition or development of AI under the EU AI Act, including your role in the AI value chain, the potential regulatory classification of your AI system or model, applicable requirements under the EU AI Act, and the principal areas of legal exposure.

Where relevant, the assessment also considers interactions with other areas of EU digital regulation, including data protection, cybersecurity and data regulation.

What you receive

🛡️ A bespoke written AI Legal Risk Assessment including:

  • an analysis of the AI product, system, model or use case from a legal perspective;
  • its potential classification and your regulatory role under the EU AI Act;
  • identification of the principal legal and regulatory risks (including for high-risk AI systems);
  • an assessment of the significance of those risks;
  • identification of relevant regulatory requirements; and
  • practical recommendations to mitigate identified risks before or during development, procurement, deployment or market launch.

The result: a decision-making tool that helps you identify legal risk early and develop or deploy AI with greater confidence.
